Our Patent Attorney Motoaki Hattori will introduce a suit to rescind patent invalidation, in which the amendments made in the substantive examination were deemed as addition of new matter.

 

The subject application was granted after amendments had been accepted in the substantive examination to replace the subordinate concept term “steering gear room” with the superordinate concept term “non-explosion proof area”. The later trial for invalidation, however, decided that the amendments were invalid and therefore the patent was invalidated. In the suit to rescind the invalidation, the Intellectual Property High Court deemed the amendments as valid upon a detailed check of the disclosure of the specification.

 

Mr. Hattori’s lecture will focus on validity of amendments, specifically whether or not amendments are deemed as addition of new matter.
